1. Agreement to These Terms
By downloading, accessing, purchasing, or using Speak New York, you agree to these Terms of Use and to the Privacy Policy. If you do not agree, do not use the app.
Speak New York is distributed through the App Store. Your download, purchase, subscription, renewal, refund, and device-level app use may also be governed by Apple Media Services Terms and Conditions, Apple's standard app license terms, App Store rules, and any mandatory consumer protection laws that apply to you.
2. App License
Speak New York is licensed, not sold. Subject to these Terms and the App Store terms, you receive a personal, limited, non-exclusive, non-transferable, revocable license to install and use Speak New York on Apple-branded devices that you own or control and as permitted by Apple usage rules.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, scrape, or create derivative works from the app, content, lesson catalog, visual assets, audio, or code except where applicable law expressly allows it despite this restriction.
3. What Speak New York Provides
Speak New York teaches practical English for New York situations through lesson stations, City Feed practice, Taxi Cards, Standard US backup phrasing, offline downloads, reminders, and progress rewards. The app is an educational product. It does not provide immigration, legal, medical, safety, financial, employment, or emergency advice.
Language examples are designed for learning and context. You are responsible for deciding what to say in real situations, especially in high-stakes conversations, professional settings, housing, medical care, emergencies, purchases, or interactions with public officials.
4. Free and Paid Access
Speak New York may include free starter content and paid Pro access. The current Pro catalog is offered through monthly, annual, and lifetime products. Availability, pricing, promotions, taxes, features, and catalog scope may vary by country, device, App Store storefront, and app version.

5. Subscriptions, Billing, and Cancellation
- Subscriptions are billed through the App Store account used for purchase.
- Monthly and annual subscriptions renew automatically unless canceled through App Store subscription settings before renewal.
- Prices, billing periods, trials, promotions, taxes, and renewal terms are shown by the App Store before purchase and may change as permitted by Apple and applicable law.
- Deleting the app does not cancel a subscription. You must manage cancellation through App Store subscription settings.
- Refund requests, billing disputes, chargebacks, and store payment issues are handled by Apple under App Store policies.
- Restore Purchases is available in the app to refresh access after reinstalling, changing devices, or resolving entitlement state.
6. Lifetime Purchase
Lifetime Pro is a one-time, non-consumable in-app purchase. It is tied to the App Store account used for purchase and can be restored through the App Store purchase system when supported. Lifetime means access to the Pro catalog offered by Speak New York for as long as the app and the relevant platform services remain available and we continue to support the product, subject to these Terms, App Store rules, and applicable law.
7. Acceptable Use
You agree not to misuse Speak New York or interfere with the app, services, users, or platform systems. You may not:
- Use the app for unlawful, harmful, abusive, discriminatory, harassing, or fraudulent activity.
- Bypass purchase checks, entitlement rules, feature gates, rate limits, or platform protections.
- Extract, clone, bulk copy, republish, or train competing systems on the lesson catalog, phrases, audio, images, screenshots, or app assets without permission.
- Upload, transmit, or send support content that contains malware, unlawful material, or personal information you do not have the right to share.
- Misrepresent your identity, ownership, purchase status, or relationship with Speak New York.
8. Educational Content and Availability
We work to keep lessons useful, respectful, and accurate, but real language changes and context matters. Slang, tone, local references, and social meaning can vary by neighborhood, relationship, identity, workplace, age, and situation. Speak New York may update, replace, add, remove, reorganize, or restrict content to improve quality, comply with law, meet App Store requirements, or protect users.
Some features may depend on iOS capabilities, device support, App Store services, remote configuration, content downloads, network availability, or third-party providers. We do not guarantee that every feature, lesson, product, price, or service will always be available in every place or on every device.
9. Your Feedback and Support Messages
If you send feedback, suggestions, corrections, support messages, bug reports, screenshots, or other materials, you give us permission to use them to operate, support, improve, market, and develop Speak New York without owing you compensation, unless prohibited by law. Do not send confidential information or personal information that is not needed for support.
10. Intellectual Property
Speak New York, including its app design, lesson structure, written content, examples, audio, images, icons, screenshots, visual system, documentation, product names, and related assets, is owned by us or our licensors and is protected by intellectual property laws. No rights are granted except the limited app license described in these Terms.
11. Disclaimers
To the maximum extent permitted by law, Speak New York is provided "as is" and "as available." We do not guarantee that the app will be uninterrupted, error-free, secure, available, accurate, complete, or suitable for your specific needs. We do not guarantee any particular learning outcome, score, job result, social result, travel result, or fluency level.
Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable law, including mandatory consumer rights.
12. Limitation of Liability
To the maximum extent permitted by law, Speak New York and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, business, opportunities, or learning progress. Where liability cannot be excluded, our liability is limited to the amount you paid for Speak New York in the 12 months before the event giving rise to the claim, unless applicable law requires a different result.
13. Suspension and Termination
We may suspend, restrict, or terminate access to Speak New York if we reasonably believe you violated these Terms, created risk, misused purchases, abused support, infringed rights, or used the app unlawfully. You may stop using the app at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, support records, and dispute-related terms.
14. Changes to These Terms
We may update these Terms when the app, products, pricing, services, App Store requirements, or legal requirements change. The updated date shows when the Terms were last revised. If changes are material, we may provide notice through the app, website, App Store metadata, or other reasonable means. Continued use after changes means you accept the updated Terms.
15. Apple Terms and Third-Party Beneficiary
For App Store downloads, Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple's standard app license framework. Apple is not responsible for providing maintenance or support for Speak New York. App Store billing, refunds, subscriptions, and purchase management are handled by Apple.
